Workplace Mediation and Dispute Resolution
Disputes can be potentially fractious and damaging to a workplace, which is why the process for addressing the problems is crucial.
Mediation is the informal and impartial negotiation process which aims to resolve difference between conflicting parties. Mediation allows both parties to communicate their issues in a safe and confidential way, without the fear of misinterpretation. The process is ideally used to resolve workplace disputes at the earliest possible opportunity, before they reach a formal Grievance or the Fair Work Commission / Tribunal.
ChildCare HRS works in assisting parties to explore their conflict in depth, think about options, consider alternatives and decide on the best way to move forward in a controlled and safe environment. Parties will be asked if they would prefer for mediation to be conducted on site or at a neutral location away from the workplace. We understand that disputes involve people who can be responding emotionally to sensitive issues. Accordingly our approach to mediation is consultative and tailored for each situation.
Mediation offers the following possible benefits:
it is less adversarial than other methods, so there is more chance that working relationships will be preserved;
hearings can occur on-site and at convenient times, which is not the case with formal conciliation and arbitration proceedings;
the parties have more capacity to take responsibility for their own decisions, and workplace relations in general — thus there is ‘ownership’ of the solution;
the framework for handling disputes is more flexible and allows scope for greater creativity and;
the process is more confidential than the more formal approaches.
